John McKay, Former US Attorney, Seattle

John McKay served as the US Attorney for Western Washington from late 2001 to early 2007.

In September 2001, President Bush nominated John McKay -- a former White House Fellow -- to serve as US Attorney for the Western District of Washington. He resigned in early 2007 with no replacement announced.

McKay's office was criticized by Washington State Republicans for failure to bring criminal charges of voter fraud in the 2004 Gubernatorial election. However, McKay told the Seattle Times:
"Had anyone at the Justice Department or the White House ordered me to pursue any matter criminally in the 2004 governor's election, I would have resigned"...

McKay insists that top prosecutors in his office and agents from the FBI conducted a "very active" review of allegations of fraud during the election but filed no charges and did not convene a federal grand jury because "we never found any evidence of criminal conduct."

McKay also wanted to make it clear that he pressed ahead with a preliminary investigation, despite the hesitation of Craig Donsanto, the longtime chief of the Election Crimes branch of the Department of Justice, who ultimately concurred with McKay that no federal crimes had been committed in the election.
McKay was championed by Justice for a judgeship in August 2006 ... then one month later put on the "discharge" list. His "effort to build a law enforcement database is the template for a new nationwide program at Justice."

McKay attended the University of Washington, where he received a Bachelor of Arts degree in political science. After working as an aide to Congressman Joel Pritchard (R-WA) from 1978-79, McKay earned his law degree at Creighton University in Omaha, NE in 1982. He was admitted to the Washington State Bar and joined the Seattle law firm of Lane Powell Spears Lubersky in 1982, eventually becoming a litigation partner.

From 1989 to 1990, McKay served as a White House Fellow, where he worked as a Special Assistant to the Director of the Federal Bureau of Investigation in Washington, D.C. From 1997 to 2001, McKay served as the President of the Legal Services Corporation (LSC) in Washington, D.C. Congress established the LSC in 1974 as a private, non-profit corporation to ensure equal access to justice under the law for all low-income Americans.
